Rule-Making Steps

Rule Making Step	Legislative	Legislative-Exempt	Interpretive & Procedural	Emergency
Rule is put out for public comment (minimum of 30 days)
After comment period ends, the next filing must include copies of comments and responses
After comment period, agency approved rule is filed with LRMRC
After comment period ends, rule can be final filed
Rule can be effective no sooner than 30 days and no later than 60 days after final filing
Rule filing will expire if nothing is filed within 6 months after close of comment period
Rule will be considered for approval by Sec. of State or AG; or goes into effect 42 days after filing
Rule will expire if notice of comment period is not filed within 30 days after filing
Rule will expire if agency approved rule is not filed within 90 after filing
Rule can remain in effect for 15 months or until legislative rule becomes effective
Rule is reviewed by LRMRC and may be approved as filed
If LRMRC recommends changes, modified rule is filed
Rule is reviewed during legislative session; may be amended on floor
Once passed, the rules bill is sent to the Governor for signature
Rule must be final filed within 60 days of the bills effective date
Rule can be effective upon final filing; no later than 90 days after
