FOIA Database Requirements

W. Va. Code § 29B-1-3a requires all public bodies to enter information about completed FOIA requests into the Secretary of State's online database after completing a FOIA request.

Public bodies do not publish copies of the requested records to the database. By law, Public Bodies publish basic information about the completed requests, including the requestor’s name, organization, summary of the request, whether any records were redacted or denied, the specific statutory exemption(s) for redaction or denial, and whether any fees were charged.
